Return to Work and Disability Management in the Workers' Compensation System (CA 14) provides an overview of return to work within the California Workers' Compensation system, including potential conflicts with other state and federal laws. This course covers procedures in accordance with the California Labor Code, Rules & Regulations, required documentation, time limitations, notices and forms, and other legal and procedural requirements. The course will explain return to work programs, the parameters of related disability discrimination laws and the role of the workers' compensation professional in effectively managing employers' disability costs through the injured employee's timely and medically appropriate return to work.
The course provides a historical review of the return to work process, role, terminology, and current benefits of the California vocational rehabilitation system. You'll be able to describe the key factors that impact medical recovery and when a Return-To-Work (RTW) program can be created; including the use of work restrictions and job analysis study. The course reviews the advantages and selling points of RTW to the various parties to the RTW program (employer, injured worker, attorney, insurance company or self-insured entity). The course reviews in detail, often with the use of simple case studies, the following RTW issues: injured worker's potential to return to work; the need for a job analysis and not just a job description; medical clearance; proper documentation; impact on PD payments; valuation of RTW; termination for cause; employer failure to offer work; employee failure to participate in the RTW program; review potential problem with VR forms, notices, and process; etc. The California Voucher system will be reviewed in one of the modules; providing a detailed overview of the SJDB (Supplemental Job Displacement Benefit), eligibility, employee benefits, SJDB forms/notices, problem, and how to manage disputes over voucher benefits. The course concludes with an overview of other RTW issues such as high PD payments, the Le Boeuf Case; the diminished future earning capacity issue; use of expert witnesses; employer defenses, integration with other benefits such as FMLA, ADA, and FEHA benefits, and other legal issues and concerns.
Workers' Compensation Adjuster Post Designation Training
This course applies 30 hours towards the training requirement for a workers' compensation claims adjuster, medical only claims adjuster, or medical bill reviewer pursuant to California Insurance Code Section 11761 and California Code of Regulations Section 2592 et esq. You must be online in the course for the full 30 hours and complete all course requirements to download and print the training certificate.
